Protecting the privacy of our visitors, our customers, our newsletter subscribers and our seminar and workshop participants is a central concern for us. We have therefore taken all technical and organisational measures to fully comply with the statutory data protection requirements (General Data Protection Regulation (Datenschutzgrundverordnung), Federal Data Protection Act (Bundesdatenschutzgesetz), German Telemedia Act (Telemediengesetz)). In the following, we wish to inform you about how we collect and use the data of visitors to our website, our customers and our seminar and workshop participants.

By agreeing to the Privacy Policy, you are consenting to the collection, processing and use of your personal data in compliance with the relevant data protection laws in accordance with the following provisions.

1. Basic principles relating to the collection and processing of personal data 

1.1. Personal data

Personal data are individual details about personal or material relationships of an identified or identifiable natural person. These include, for example, name, address, telephone number, e-mail address, all bank details and all other information that you provide us with for the purpose of placing an order for goods or participating in a seminar, for example.

1.2. Collection, processing and use of your personal data

We only collect, process and use your personal data if you have previously consented to this or if permitted by law or if we are under a legal obligation to do so. If it is sufficient to use anonymous or pseudonymous data for the given purpose, we will limit ourselves to collecting and using such data only. The details of how we collect, process and use your data are as follows:

1.2.1. Log files

Each time you visit our website user data are forwarded by the respective Internet browser and stored in server log files. The datasets stored contain the following data: date and time of access, name of the requested page, IP address, source URL from which you arrived at our site, volume of data transferred, information about the browser you are using. These data are used exclusively for technical communication and are deleted, subject to any statutory retention obligations, once they have ceased being used.

According to Art. 6 (1) (f) General Data Protection Regulation (“GDPR”), data processing for those purposes is necessary to ensure our legitimate interests. In no event, the processed data will be used to draw conclusions to your person.

1.2.2. Ordering goods and booking seminars

When you order goods from us or book a seminar with us, we collect, store and process your personal data in order to establish and perform the contractual relationship (purchase of goods) with you. This includes providing advice and assistance, invoicing, handling the payment transaction and postage, processing customer complaints and liability for defects. Personal data will also be collected, stored and processed when you request a notification that an out of stock product is available to purchase again.

When you order goods, we collect, store and process the following personal data:

  • your e-mail address
  • your first names and last names
  • your address
  • your telephone number
  • the name of your company, if you are ordering on behalf of a company.

Providing a telephone number and the name of the company are optional. All other information is mandatory.

If the delivery address is different from the invoice address, we additionally collect, store and process:

  • the first names and last names of the recipient, should these differ from the recipient of the invoice
  • the address
  • the telephone number
  • the name of the company to which the delivery is to be made, where appropriate.

Providing a telephone number and the name of the company are optional. All other information is mandatory.

We will use those data for the sole purpose of processing your order(s) and fulfilling the services you requested.

The processing of those data for the above mentioned purposes is executed upon your request and, according to Art. 6 (1) (b) GDPR, is necessary for the mentioned purposes to adequately process the contractual relationship and to fulfill the obligations arising thereof.

We will delete those data as soon as the mentioned data are no longer necessary for processing the mentioned contractual relationship.

1.2.3. Customer account

In order to communicate with us more easily and faster, you can set up a customer account with us. In additional to the data collected under 1.2.2., we additionally collect, store and process a password which you choose yourself as well as the user name you chose if applicable. We will store the data corresponding to your account for the sole purpose of processing your order respectively fulfilling the services you requested.

Art. 6 (1) (b) GDPR is the legal basis of this data processing.

Registered clients may change or completely remove their registered personal data from our database at any time, as long as no contradictory legal retention duties exist.

1.2.4. Newsletter

You can register for our free newsletter either via our website or by providing your e-mail address and signing a declaration of consent in our shop. In order to register, we require your e-mail address. We use what is known as the “double opt-in” procedure for this purpose.

After entering your e-mail address or after placing a tick in the box as an expression of your consent in the framework of the order process or after granting your written consent in our shop, you will receive a confirmation e-mail from us.

Your registration only becomes effective once you have clicked on the link in the confirmation e-mail. If you have signed up for the newsletter, you have submitted the following consent declaration:

I agree to The English Tearoom sending me advertising in the form of newsletters.

We only use the e-mail address you provided when subscribing to the newsletter for the purpose of sending the newsletter. You can unsubscribe from the newsletter at any time. To unsubscribe, you can use the unsubscribe link at the bottom of every e-mail or use the unsubscribe function on our website. You can also unsubscribe by sending us an e-mail, telephoning us or informing us personally in our shop. We will then immediately delete your e-mail address from our distribution system.

Art. 6 (1) (a) GDPR is the legal basis of the data processing for those purposes. If you revoke your approval, we will delete your data which we have stored for that purpose.

1.2.5. Contacting us

If you contact us by e-mail, telephone or post, we will store the data and contact data you provide in your enquiry for the purpose of processing your enquiry and for any additional questions. We will not pass these data on to third parties.

Data processing for first contact with us is based on your voluntary approval according to Art. 6 (1) (a) GDPR. We will delete all personal data collected in that context as soon as we have dealt with your request.

1.3. Passing on personal data

We only pass on and transfer your personal data to service providers that we use in the framework of the contracts we have entered into with you for the purpose of performing and processing these contracts (e.g. transport companies, post office, banks) if this is necessary for the purpose of performing the contract and invoicing or if you have consented hereto.

The data passed on in this manner may only be used by our service providers for the purpose of performing these tasks specified by us. The data may not be used for any other purpose.

Subject to the above provisions, your personal data will, under no circumstances, be disclosed or passed on to third parties for advertising, marketing or other purposes without your consent. This only does not apply if we have a statutory duty or have received an official order to surrender the data, especially in cases of criminal prosecution or for security purposes.

1.4. Cookies

Our website uses cookies. Cookies are alphanumeric identifiers that are either stored temporarily in your main storage and deleted as soon as you close your browser (“session cookies”) or for a longer period (“temporary cookies”) or permanently (“permanent cookies”). With the exception of the website analysis service Google Analytics (see section 1.5) and the temporary cookies described below, which are deleted 24 hours after your last visit to our website, we exclusively use session cookies to maintain the connection during your visit to our site. We do not use any other permanent cookies.

The session cookies are required, for example, in order to offer you the shopping basket function over several pages. The temporary cookies help anonymous users of our website who have placed items in our shopping basket to find this shopping basket again after closing the browser and returning to our site and enable users who have logged in to stay logged in, even if they have briefly left the site. These temporary cookies are automatically deleted after the time stated and primarily serve to make our service user-friendly, efficient and comfortable.

In your browser settings you can opt to refuse cookies, to delete them from your machine, to block them or to activate the option to be asked before setting cookies. It is not necessary to enable cookies in order to use our website. However, we wish to point out that individual functions may not work properly if you have disabled cookies.

Example based on the Internet Explorer browser:

  1. Open Internet Explorer.
  2. Click on “Tools” and then on “Internet Options”.
  3. Click on the “Privacy” tab.
  4. Now you can choose whether to allow, customise or block cookies.
  5. Click “OK” to confirm your settings. 

Example based on the Firefox browser

  1. Open the Firefox browser.
  2. Click on “Settings” and then on “Options”.
  3. Click on the “Privacy” tab.
  4. Select “Use custom settings for history” from the drop-down menu.
  5. You can now choose whether to accept cookies, how long you want to store them and can add as exceptions the websites from which you always or never want to accept cookies.
  6. Click OK to confirm your settings.

Example based on the Safari browser:

  1. Open the Safari browser.
  2. Select “Preferences” (pictogram: grey cog wheel in the upper right corner) and click on “Privacy”.
  3. Under “Accept cookies” you can set whether and when Safari should accept cookies from websites. For further information, click on “Help” (?).
  4. If you need further information about cookies which are stored on your computer, click on “Show Cookies”.

Example based on the Google Chrome browser:

  1. Open Google Chrome on your computer.
  2. Click on the  symbol at the top right.
  3. Click on “Settings, Show Advanced Settings”.
  4. Click on “Content Settings” under “Privacy”.
  5. Change your settings under “Cookies”:
  6. To block all cookies, click on “Block sites from setting any data”. If you choose this function, most websites which require registration will not work.
  7. In order to only accept first-party cookies and to block all third-party cookies, activate the option “Block third-party cookies and site data”. This setting means that website data can neither be written nor read even if you have added a website to your exception list and have chosen to accept cookies from this website.
  8. In order to accept both first-party and third-party cookies, click on “Allow local data to be set”.

Checking that the settings have been saved

If you access a website and a cookie is blocked, the symbol for blocked cookies  appears in the address bar. 

To ensure our legitimate interests, the use of respective cookies is necessary according to Art. 6 (1) (f) GDPR. We use them to generally make our internet services more user-friendly and more effective. In no event, the processed data will be used to draw conclusions to your person.

1.5. Website analytics – Google Analytics 

This website uses Google Analytics, a web analytics service of Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files saved on your computer, which make it possible to analyse how the website is used. The information generated by the cookie about your use of this website is normally transmitted to a Google server in the USA and stored there.

In the event that IP anonymisation is activated on this website, your IP address will first be shortened by Google in the Member States of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shorted there. On behalf of the operator of this website, Google uses this information in order to analyse your use of the website, to draw up reports on the website activities and for the purpose of providing further services connected with use of the website and Internet use for the website operator. The IP address transmitted by your browser in the framework of Google Analytics is not amalgamated with other Google data. Conferences and campaigns will be stopped after a certain period of time. Generally, conferences will be stopped after 30 minutes of inactivity, campaigns after six months. In order for IP addresses to be collected in an anonymised manner, Google Analytics has been supplemented by the code “gat._anonymizeIp();” so that IP addresses are only processed in their shortened form. This ensures that they cannot be directly associated with individual users.

Art. 6 (1) (f) GDPR is the legal basis for tracking measures performed by Google Analytics. One the one hand, we hereby want to ensure a needs-based design and the continuing optimization of our website. On the other hand, this measure enables us to statistically record the use of our website and to analyze it to optimize our services.

1.6. Plugins:

To protect your privacy, we have chosen not to include direct links to our Facebook or Instagram accounts and therefore do not use plugins such as the “like” button. If you would like to follow us and like our activities on Facebook or Instagram, please do so independently of this website.

2. Subject’s rights

You have the right to:

  • request information about your personal data we process according to Art. 15 GDPR. You have especially the right to request information about the purposes of processing, the category of your personal data, the categories of recipients whom your data were or will be disclosed to, the planned storing time, the existence of a right to correction, deletion, restriction of processing or objection, the existence of a right to complain, the source of your data, when they are not collected by us as well as about the existence of an automatic decision making including profiling and, if any, significant information to their details;
  • request the immediate correction of any wrong personal data of yours or the completion of your personal data we stored according to Art. 16 GDPR;
  • request the deletion of your personal data we stored according to Art. 17 GDPR, as long as the processing is not needed to execute the right for freedom of expression and information, to fulfil a legal commitment, for reasons of public interest or to ensure, execute or defend legal rights;
  • request the restriction of processing your personal data according to Art. 18 GDPR, as long as you deny the accuracy of that data, the processing is illegal but you reject their deletion and we do not need the data anymore but you need them for enforcing, executing or defending legal rights or you have objected the processing according to Art. 21 GDPR; 
  • request to get your personal data you provided to us in a structured common and readable format or to request the disclosure to another responsible according to Art. 20 GDPR;
  • reject a permission you once gave us at any time according to Art. 7 (3) GDPR; to do so, an according email to hello@the-english-tearoom.de is sufficient. As a result, we must not continue data processing that was based on this permission in the future;
  • complain to a supervising authority according to Art. 77 GDPR. You can usually contact the supervising authority of your usual residence, of your office or of our headquarters.

3. Right of objection

If your personal data are processed on the basis of legitimate interests according to Art. 6 (1) (f) GDPR, you have the right to object to the processing of your personal data according to Art. 21 GDPR, as long as there are reasons that arise out of your personal situation or the objection is against direct advertising. In the latter case, you have a general right of objection that will be executed by us without naming a specific situation. If you want to exercise your right of objection, an according email should be sent to hello@the-english-tearoom.de.
